Modern Leisure shall not be liable for any delays, loss, or damage in transit. Unless otherwise agreed to in writing by the parties, Modern Leisure shall use their standard methods for packaging and shipping Goods and shipment shall be in accordance with Modern Leisure’s then-current shipment methods. Title and risk of loss shall pass to you upon receipt of full payment by Modern Leisure. Modern Leisure may, in its sole discretion, without liability or penalty, make partial shipments of any Goods purchased through this site. Each shipment will constitute a separate sale, and you shall pay for the units shipped whether such shipment is in whole or partial fulfillment of your order.

You agree to purchase the Goods from Modern Leisure at the price(s) set forth in Modern Leisure’s then-current price list in force as of the date of purchase. All prices are exclusive of all sales, use and excise taxes, and any other similar taxes, duties, and charges of any kind imposed by any governmental authority on any amounts payable by you. You shall be responsible for all such charges, costs, and taxes. You agree to pay all amounts due to Modern Leisure prior to shipment of any Goods in accordance with Modern Leisure’s payment instructions and in U.S. dollars. In addition to all other remedies available under these Terms of Use or at law (which Modern Leisure does not waive by the exercise of any rights hereunder), Modern Leisure shall be entitled to suspend the delivery of any Goods if you fail to pay any amounts when due hereunder. You shall not withhold payment of any amounts due or payable by reason of any set-off of any claim or dispute with Modern Leisure, whether relating to Modern Leisure’s breach or otherwise.

WARRANTY AND RETURNS: Modern Leisure warrants Goods purchased from this site in accordance with its Warranty and Return/Exchange Policy, which is incorporated by reference into these Terms of Use.

You shall comply with all applicable laws, regulations, and ordinances. You shall comply with all export and import laws of all countries involved in the sale of the Goods under these Terms of Sale and shall not export, re-export, divert, or transship any Goods. You assume all responsibility for shipments of Goods requiring any government import clearance.

In addition to any excuse provided by applicable law, Modern Leisure shall be excused from liability for non-delivery or delay in delivery of goods available through our site arising from any event beyond our reasonable control, whether or not foreseeable by either party, including, without limitation, labor disturbance, war, fire, accident, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.
